Can you notarize on Sunday in NY? ›

While notaries are typically prohibited from notarizing their own documents, there are cases in which they may sign as both the notary and a witness. Certain documents require the signatures of one or more witnesses in addition to notarization.

If the signer doesn't meet certain criteria, the notary may refuse to notarize the document. Here are some situations that apply: The signer isn't there in person (unless the notary is performing a remote notarization). The signer doesn't have a photo ID or otherwise can't be properly identified.

For example, a will execution ceremony under New York law requires the testator and the witnesses to be in each other's physical presence, and notarization of the signatures on a trust document requires the notary to see the creator and the trustee sign.

But not all states recognize handwritten wills as valid. New York, for example, does not, except for very limited circumstances. Only certain people are permitted to make holographic wills in New York, and only in certain circumstances.
